The appellant is challenging the judgment in OP.No.714/2011 of the Family Court, Thalassery. The original petition was filed by the respondent herein, the wife, seeking dissolution of marriage under section 2 of the Dissolution of Muslim Marriages Act. The court below allowed the original petition and granted a decree of dissolution of the marriage.

2. When the appeal came up for admission on today, after condonation of the delay, learned counsel appearing for the respondent submitted that the respondent had already got remarried. Therefore the counsel appearing for the appellant submitted that the appeal can be closed as infructuous, recording the above submission.
