Learned counsel for the appellant submits that the respondent died and the appellant along with her daughter are the only legal heirs. Hence permission is sought from this court to withdraw the appeal, without prejudice to the rights of the appellant and her daughter to move before the appropriate authority for getting the benefits which is due to the respondent on the basis of his past service.
