The appellant filed O.P.No. 298 of 2007 on the file of the Family Court, Kozhikode against the respondent for divorce. The Family Court dismissed the original petition as per the order dated 31.10.2008, which is under challenge in this Mat Appeal. The learned counsel for the appellant submitted that the appellant died and therefore, the appeal has become infructuous. Accordingly, the appeal is dismissed as infructuous. Sd/- K.T.
