Counsel appearing on both sides conceded that the issue involved in this case no more survives for consideration in view of the mediation settlement arrived in RP(FC).No.139/2010. In the memorandum of agreement produced along with the report of the Mediator, the respondent herein had agreed that she has no objection to allow the above appeal and to grant divorce dissolving the marriage in question.

2. Therefore the above Mat.Appeal is allowed and divorce is granted by allowing OP.No.767/2009 on the files of the Family Court, Malappuram.
