J U D G M E N T

The petitioner initiated criminal proceedings against the respondent which, unfortunately for the petitioner, ended in discharge which was challenged in appeal and the appeal was dismissed for default.

2. It is pointed out by the learned counsel for the petitioner that the petitioner challenged the order dismissing the appeal in revision and it is pending before this Court. Meanwhile, the respondent instituted a suit for malicious prosecution and that is nearing trial. The petitioner moved an application under Section 10 of the Code of Civil Procedure which was dismissed by the court below. The petitioner points out that before the Civil Revision Petition is heard, if the suit is tried, it will cause irreparable loss and injury to him.

It is extremely difficult to hold that a petition under

O.P.(C) No.610/2015 Section 10 of the Code of Civil Procedure is maintainable. The court below was right in dismissing the same. Leaving open the right of the petitioner to move appropriate forum for necessary reliefs, this original petition is disposed of. The trial of the suit shall stand deferred by ten days.
