J U D G M E N T
The petitioner herein is the defacto complainant in C.C No.282/2014 of the Additional Chief Judicial Magistrate Court, Thiruvananthapuram. She seeks a direction under Article 227 of the Constitution to the trial court to expedite the trial and disposal of the case, on the consideration that she is a senior citizen. There is a report by the learned Magistrate that the accused has not so far appeared in the case, and that warrant of arrest is now pending. The learned Magistrate has also reported that the case could be disposed of within four months from the date of appearance of the accused. The accused, who is the 2nd respondent herein is represented by learned counsel. The learned counsel submits that the accused will surrender before the learned Magistrate on or before 20.11.2015. In such a situation, the report of the learned Magistrate that the case could be disposed of within four months from the date of appearance is recorded, and the Original petition is closed.
