J U D G M E N T

The petitioner has approached this Court for a direction to the Family court, Kollam, for an early disposal of O.P. (HMA) No.1392/13, alleging that the pendency of the above original petition will cause lots of hardships to the petitioner as well as her parents.
2. This Court obtained a report dated 13.2.2015 from the Family court concerned and as per the said report, as on 31.1.2015, the pendency of the cases of the said court is 3,362. It is further reported that in more than 25 cases, this Court had issued time bound directions for disposal. It is also stated that, if time bound directions are issued in new cases, the Family court will not be able to concentrate on old cases.
3. O.P.(HMA) No.1392/13, which is pending in the Family court, Kollam, was filed for declaration of marriage of
O.P.(F.C.)No.38 of 2015 the petitioner with the respondent as null and void and the said case was filed on 6.11.2013. According to the petitioner, thereafter, there were several postings of the case, but nothing turned fruitful.
4. As various formalities have to be completed before proceeding with the trial, this Court is of the view that, it may not be just and proper to fix a time frame for disposal of the said petition pending before the said court.
5. However, considering the submissions made by the learned counsel for the petitioner, this original petition is disposed of directing the Family court, Kollam, to dispose of the afore said original petition as expeditiously as possible.
