JUDGMENT

K. Ramakrishnan, J Respondent in M.C.No.22/2014 and O.P.No.21/2014 and petitioner in O.P.No.167/2013 and O.P.No.168/2013 are pending before the Family Court, Ernakulam has approached this court seeking interference of this court under Article 227 of the Constitution of India for speedy disposal of the cases.

The averment in the petition was that M.C.No.22/2014 in O.P.No.21/2014 was filed by the respondent herein while O.P.No.167/2013 and 168/2013 were filed by the petitioner herein, seeking appropriate reliefs. Though counselling and mediation were over and pleadings are completed, the cases have not taken for disposal. Unless final decisions are taken in those matters,

future of both parties will be affected. So the petitioner has no other remedy, except to approach this court, seeking speedy disposal of these cases.

On the basis of the allegations, we have called for a report from the Family Court, Ernakulam and the Family Court, Ernakulam has sent a report stating that the pleadings in these cases were completed and counselling and mediation were also over and the cases are posted to 08.07.2015. It is also mentioned in the report that for the year 2015-2016, thousand cases were included in the target and all O.P.s up to the period 31.12.2012 also included in the target for disposal before the month of May, 2016. However expressed desire to dispose of the above cases before 31.01.2016, if both parties co-operate with the trial of the cases.

Under the circumstances mentioned, we do not find any reason to issue any direction as such and the report of the Family Court, Ernakulam is recorded and the petition

is disposed of accordingly.

Office is directed to communicate this order to the concerned court, immediately.
