J U D G M E N T

The petitioner herein is the third accused in S.C No.918 of 2013 of the court of Session, Alappuzha. She seeks a direction for speedy disposal of the case on the ground that she is now aged 70 years, and is having some ailments. As required by the court, the learned Sessions Judge submitted a report on 24.9.2014. Of the five accused arraigned in the complaint, three including the petitioner are before the court of Session, facing trial, and the other two accused are now facing trial before the Juvenile Justice Board. The learned Sessions Judge has reported that there are two other connected cases, and that trial in one of the cases is in progress. The other is a case involving the offence under Section 302 IPC. That case also stands scheduled for trial from 6.10.2014.

However as regards this case, the learned Sessions Judge has reported that time for six months is required to dispose of S.C 918 of 2013. In the given circumstances, it would be inappropriate to direct a time bound disposal.

O.P (Crl.) No.189 of 2014 earliest.

The report submitted by the learned Sessions Judge that the case could be tried and disposed of within 6 months, is recorded, and this Original Petition is closed.
