J U D G M E N T
The petitioners are the claimants in O.P(M.V) No.2383 of 2005 on the files of the Additional Motor Accidents Claims Tribunal/Additional District Court-VII, Trivandrum. The claim itself arose from an accident, which occurred in 2005 and the deceased, is stated to be the only bread winner of the family. The wife and children of the deceased are before this Court claiming expeditious disposal of the said claim. It is also stated that since, there is no Presiding Officer at present in the Additional Motor Accidents Claims Tribunal/Additional District Court-VII, Trivandrum, the matter is not being taken up.
2. Considering the fact that the claim petition itself was filed as early as on 05.12.2005, it is only proper that the matter be disposed of at an earlier date. It is also submitted that the evidence has not commenced. O.P(M.V) No.2383 of 2005 shall be transferred from the Additional
O.P(M.A.C) No.10 of 2015 - O Motor Accidents Claims Tribunal/Additional District Court-VII, Trivandrum to the Principal Motor Accidents Claims Tribunal, Trivandrum. The parties shall appear before the Principal Motor Accidents Claims Tribunal, Trivandrum on 18.02.2015. The Principal Motor Accidents Claims Tribunal, Trivandrum shall endeavour to record the evidence and conclude the matter at any rate within six months from the date of appearance of the parties. In the nature of the orders passed, this Court has not issued notice to any of the respondents. Notice of the transfer shall be displayed on the notice board of the Additional Motor Accidents Claims Tribunal/Additional District Court-VII, Trivandrum. The claimants/petitioners herein shall serve notice of the aforesaid judgment to the Counsel appearing for the respondents before the Tribunal and file memo before the Tribunal.
The writ petition is disposed of.
