JUDGMENT
The petitioner who was working as Senior Accounts Officer in the Inland Waterways Authority of India has filed this Writ Petition seeking the following reliefs:
"a. Issue a writ of certiorari or other appropriate writ, order or direction calling for the records leading to the issue of Exhibit P7 and quash the same,;
b.
Issue a writ of certiorari or other appropriate writ, order or direction calling for the records leading to the issue of Exhibit P9 and quash the same.
c.
Declare that the petitioner is entitled to be granted the benefit of the first financial up-gradation in scale of 10,000-15200/- with effect from 30.10.99;
₹ d.
Issue a writ of mandamus or other appropriate writ, order or direction commanding the respondents to grant and pay the petitioner, the benefit of the first financial upgradation in the scale of pay of 10,000-15200/- ₹ w.e.f.30.10.99 with all consequential arrears of pay and allowances emanating therefrom;
e.
In the alternative, issue a writ of mandamus or other appropriate writ, order or direction commanding respondents 1 to 4 to implement Exhibit P8 forthwith an to grant the petitioner the first financial up-gradation in scale 10,000-15200 with effect from 30.10.99 with all ₹
W.P.(C).No.3089/06 -2arrears of pay and allowances arising therefrom. f.

The respondents have filed a counter affidavit contending, inter alia, that the petitioner is not entitled for the reliefs sought for.

During the pendency of the Writ petition the petitioner was charge sheeted under Section 7 of the Prevention of Corruption Act by the Central Bureau of Investigation, Ernakulam and a crime was registered as Crime No.RC. 06(A)/2006. Ext.R1(j) is the judgment of the Special Judge (SPE/CBI)-I, Ernakulam in C.C.No.5/2006 by which the petitioner was found guilty and sentenced to undergo rigorous imprisonment for 3 years and to pay fine of 50,000/-, in default to undergo rigorous imprisonment for ₹ 6 months under Section 7 of the Prevention of Corruption Act and also to undergo rigorous imprisonment for a period of 3 years and to pay fine of 50,000/-, in default to undergo rigorous ₹ imprisonment for 1 year for the offence punishable under Section 13(2) read with 13(1) (d) of the Prevention of Corruption Act. 4.
Pursuant to Ext.R1(j) judgment, disciplinary proceedings were initiated against the petitioner under the provisions of the Central Civil Service (Classification, Control and Appeal) Rules,
W.P.(C).No.3089/06 -31965 and consequently he was dismissed from service by Order No.9-IWAI/Estt./2/2006 Pt-I dated 27.12.2011 Ext.R1(k) is a copy of the said order. Now W.P.(C)No.7105/2012 filed by the petitioner challenging Ext.R1(k) order is pending before the High Court of Delhi.

Since the petitioner has already been convicted for an offence punishable under the provisions of the Prevention of Corruption Act, by Ext.R1(j) judgment, and that he was also imposed with a punishment of dismissal from service by Ext.R1(k) order passed by the Disciplinary Authority, which is now under challenge in W.P.(C)No.7105/2012 pending before the High Court of Delhi, the petitioner is not entitled for the relief sought for in this writ petition at this point of time.

In such circumstances, this Writ petition is closed, leaving open all the contentions raised by the petitioner and reserving his right to re-agitate the issue once he is acquitted in the criminal case and his order of dismissal is reversed. No order as to costs.
