JUDGMENT

The parties to the second appeal have settled their disputes by recourse to mediation. The memorandum of settlement arrived at by them at the mediation is part of the records. In the light of the settlement arrived at by the parties at the mediation, the judgments impugned in the second appeal are set aside and suit O.S.No.99 of 2003 on the file of the Sub Court, Palakkad is disposed of in terms of the settlement. A copy of the memorandum of settlement shall be appended to this judgment and the original shall be preserved.

Since the matter has been settled by recourse to mediation, in view of the provision contained in Section 69A of the Kerala Court Fees and Suits Valuation Act, the whole
