JUDGMENT

Antony Dominic, J.

This appeal is filed by the defendant in O.S.167/2010 on the file of the Sub Court, Mavelikkara who is aggrieved by the judgment and decree passed on 30.9.2013. The appeal was referred for mediation by order dated 17th September 2015. Accordingly, the dispute was mediated at the Ernakulam Mediation Centre and the parties have entered into agreement dated 19th November 2015 settling the disputes. In view of the settlement thus arrived at, this appeal is disposed of, directing that the parties will be governed by the terms of the memorandum of settlement, terms of which will form part of the decree in this appeal. The appellant will also be entitled to refund of the court fee paid on the appeal.
