JUDGMENT

This appeal is filed by the defendant in O.S.134/11 on the file of the Additional Sub Court, Kottayam, who is aggrieved by the judgment and decree rendered 5.6.2014. By order dated 5.10.2015, this appeal was referred for mediation. Accordingly, the dispute was mediated and the parties have entered into a memorandum of agreement dated 13.10.2015 settling the entire disputes. The parties will be governed by the terms of the agreement of settlement and the appeal will stand dismissed recording the same. The settlement agreement will form part of the judgment.
Appellant will be entitled to refund of the court fee paid on the appeal.
