O R D E R

The petitioner has filed the review on the ground that it was mistakenly submitted that there was an appeal filed and hence the judgment has to be reviewed. However, it is evident that Ext.P3 is an appealable order.

2. In such circumstance, this Court is not inclined to exercise its discretionary remedy under Article 226 of the Constitution of india to consider the sustainability of Ext.P3, when there is an alternate remedy available. The petitioner definitely will have to move the appeal as provided under the statute. The review petition is hence allowed, and the writ petition is allowed directing the petitioner to file an appeal if so advised, within two weeks from the date of receipt of a certified copy of this judgment.
