Ashok Bhushan, CJ This writ appeal has been filed by the writ petitioner against the judgment dated 06/07/2011 by which the writ petition was dismissed with the observation that the petitioner may approach the Civil court for the relief sought for.
2.
The petitioner, who claims to be an executive member of the 1st respondent, had filed the writ petition praying for striking off Clause 23(c) from Ext.P1 byelaw. The learned Single Judge has rightly relegated the petitioner to approach the Civil Court.
3.
It has been submitted by the learned counsel for the 3rd respondent that the petitioner has already filed a civil suit which was dismissed and the matter is pending in appeal.
W.A.No.1233/2011 -:2:- 4.
We, however, do not find any ground to interfere with the judgment of the learned Single Judge.
This writ appeal is dismissed.
