O R D E R

The petitioner herein is the accused in C.C No.5329 of 2014 before the Judicial First Class Magistrate's Court, Chalakudy. She is the accused in another case before the Additional Chief Judicial Magistrate's Court, Ernakulam. The complainant is same in these two proceedings. She is the respondent herein. The petitioner seeks transfer of C.C.5329 of 2014 to the Court of Additional Chief Judicial Magistrate's, Ernakulam. This request is not opposed by the respondent. I feel it appropriate to transfer the case as requested, especially when the complainant has no objection.

In the result, this petition is allowed. C.C No.5329 of 2014 of the Judicial First Class Magistrate's Court, Chalakudy will stand transferred to the Additional Chief Judicial Magistrate's Court, Ernakulam. The learned Judicial First Class Magistrate, Chalakudy will transmit the records of the case to the other court, without any delay.
