O R D E R

~ ~ ~ ~ ~ ~ Two cases were registered as case and counter. After investigation of the main case, the matter was taken up as committal proceedings before the Judicial First Class Magistrate's Court, North Paravoor and the case against the accused was committed. At the same time, the crime in the counter case also culminated in a final report and the same was taken on file before the Judicial First Class Magistrate's Court, North Paravoor as CC No.1498/2013. The other case was taken on file as SC No.700/2014 and the same is made over to the Additional Assistant Sessions Court, North Paravoor for trial and disposal. The petitioner is accused in SC No.700/2014, and the de facto complainant in CC No.1498/2013.

By exercising the powers conferred on this Court

Tr.P.(Crl.).80/2015 : 2 :

under Section 407(1)(c)(iii) Cr.P.C., the Judicial First Class Magistrate's Court, North Paravoor is hereby ordered to commit the case against the accused in CC No.1498/2013 to the Court of Sessions as it is expedient for the ends of justice. The Court of Sessions on getting the case committed, shall make over the case to the Additional Assistant Sessions Court, North Paravoor for trial and disposal along with SC No.700/2014.

Tr.P.(Crl.) is allowed accordingly.
