O R D E R

This is a petition filed under Section 24 of C.P.C. seeking transfer of O.P.No. 445/2014 pending before Family Court, Kozhikode to Family Court, Palakkad.

Suffice to say that the marital relationship between the petitioner and the respondent ran into rough weather and litigations began. The petitioner has filed O.P. (M)No.324/2014 before the Family Court, Palakkad for divorce. As a retaliatory measure, the respondent is alleged to have filed O.P.No.445/2014 before the Family Court, Kozhikode in order to harass the petitioner.

The petitioner points out that she is a permanent resident of Palakkad and she finds it difficult to go out to Kozhikode to attend the routine posting of the case. She also says that she is in financial difficulties and she has nobody to accompany her. Therefore, she prays for a

Tr.P.(C) No. 307 of 2014 -2transfer.

Though notice was served on the respondent, there is no appearance on his behalf.

In the light of the fact that there is no appearance on behalf of the respondent and no objection is seen filed, this petition is allowed and O.P.No. 445/2014 pending before the Family court, Kozhikode shall stand transferred to Family Court, Palakkad.
