O R D E R

This is a petition filed under Section 24 of C.P.C. seeking transfer of O.P.No. 2059/2013 pending before Family Court, Attingal to Family Court, Kollam to be tried along with O.P.No.1558/2013 pending before the latter Court. 2.

The marital relationship between the petitioner and the respondent ran into rough weather and litigations began. The petitioner instituted O.P.No. 1558/2013 to the Family Court, Kollam for various reliefs. It is contended that as a retaliatory measure, the respondent instituted O.P.No.2059/2013 before Family Court, Attingal for divorce. The petitioner points out that she finds it extremely difficult to go out to Attingal to attend the case on every posting date and she has nobody to accompany her to go to Attingal and she is in financial difficulties. She therefore prays for a transfer. It is also contended that since other matters are

Tr.P.(C) No. 602 of 2014 -2already pending before the Family Court, Kollam, it is only appropriate that all the cases be tried by the same court so as to avoid conflict of decision.

Though notice was served on the respondent, there is no appearance on his behalf.

This petition is allowed and O.P.No. 2059/2013 pending before Family Court, Attingal shall stand transferred to Family Court, Kollam.
