O R D E R

The petitioners herein are the accused in C.C No.39 of 2011 of the Judicial First Class Magistrate Court, Muvattupuzha. They seek transfer of the case to some other court in the District on the ground that the learned Assistant Public Prosecutor in charge of the case in the said court is a close relative of the de facto complainant. A request made by them before the learned Sessions Judge was disallowed. Now it is submitted by the learned Public Prosecutor that the learned Assistant Public Prosecutor stands transferred to some other court. In such a situation this proceeding need not continue.

In the result, this transfer petition is closed, in view of the transfer of the learned Assistant Public Prosecutor from the Judicial First Class Magistrate Court, Muvattupuzha.
