JUDGMENT

Antony Dominic, J.

1.This appeal is filed aggrieved by the judgment of the learned single Judge dismissing W.P(C).12754/15 filed by the appellant. In the writ petition, the appellant challenged Ext.P8 order passed by the first appellate authority granting stay on condition that the appellant deposits 30% of the demand. This order was confirmed by the learned single Judge in the judgment under appeal.

2.We heard learned counsel for the appellant and learned Government pleader appearing for the respondents.

3.Submissions made by the learned counsel for the appellant are to the effect that the appellant has a strong case on merits. In our view, even if it is so, when the interlocutory application for stay is considered, that would only entitle the appellant an order of stay, conditions of which are to be decided

WA.1169/15 by the appellate authority taking into consideration the merits also. It was accordingly that the appellate authority has considered the rival contentions and imposed the condition, requiring the appellant to deposit 30%. The judgment of the learned single Judge confirming the order of the first appellate authority does not suffer from any irregularity or illegality. However, taking note of the submissions made, we extend the time for payment of the amount due in Ext.P8 by two weeks from today. Appeal is dismissed.
