J U D G M E N T

We have heard the learned counsel for the appellants. This appeal is against the judgment of the learned single Judge refusing to entertain a writ petition. The appellants/writ petitioners sought interference with Ext.P10 order of the Government by which it was decided to upgrade the school. For one thing, that order is dated 29.05.2001. More importantly, the second petitioner claims to be the president of the parent teacher association and his son is stated to be studying in that school. One fails to understand why he is not interested in having the school upgraded. If there is lack of facilities and if the facilities are not up to the bench mark of the provisions of the Kerala Education Act and Rules or different directions of the Government and other authorities as regards facilities of the school, the positive and

WA1787/14 -2proactive approach that a parent or president of the parent teacher association should take is to ensure that facilities are brought home to the school rather than try to scuttle development of the school, which is shown to have been established way back in 1945. The writ petition was thoroughly misplaced. The learned single Judge was fully justified in dismissing the same, however, magnanimously with no order of costs. We would have been persuaded to impose costs in this appeal, if the respondents were notified of this appeal. However, that not having been done, we dissuade ourselves from doing so and dismiss this writ appeal, at the threshold. (THOTTATHIL B.RADHAKRISHNAN, JUDGE) (K.HARILAL, JUDGE) jg
