JUDGMENT
The petitioner is conducting service on the route Kottayam-Karukachal via Thottakadu Hospital Junction, Manthuruthy on the strength of a temporary permit issued to the stage carriage bearing registration No.KL 5/M 7344. The permit is valid till 9.1.2014. The same is issued in place of Stage carriage bearing No.KL 6/B 8593. The petitioner has approached this Court with a prayer to direct the respondent to re-issue temporary permit to the petitioner's stage carriage No.KL 5/M 7344 on the route Kottayam-Karukachal via Thottakadu Hospital Junction, Manthuruthy.
2. If vacancy of stage carriage bearing registration No.KL 6/B 8593 is still in existence and no other person having a better claim has applied for the same, there will be a direction to the 1st respondent to re-issue a temporary permit of four months duration within a week from the date of production of a copy of this judgment by passing appropriate orders on Ext.P2.
WP(C).230/14 Needless to say, such issuance of temporary permit will be subject to any preferential claim.
Writ petition is disposed of as above.
