========================= W.P.(C) No.113 of 2015 ============================ Dated this the 4th day of March, 2015

JUDGMENT

This is the second round of litigation that the petitioner is pursuing before this Court. Earlier, W.P.(C) No.5682 of 2014 was filed because of the laxity on the part of the concerned respondent in considering the application preferred to effect mutation. The said writ petition was disposed of as per Ext.P10 judgment dated 03.06.2014, whereby the Additional Thasildar was directed to consider and pass appropriate orders on the application within the time as stipulated therein. Pursuant to the above verdict, the rights and liberty of the petitioner were established before the 3rd respondent, who passed Ext.P11 order dated 15.07.2014, whereby the grievance of the petitioner was redressed and necessary orders were passed to cause the mutation to be effected in terms of the Kerala Transfer of Registry Rules, 1966. Even though the petitioner has brought it into the notice of the 5th respondent, no

W.P(C) No.113 of 2015 consequent steps have been taken, by virtue of which the petitioner is not in a position to satisfy land tax in terms of the Karala Land Tax Act and this made the petitioner to approach this Court again, by filing this writ petition.

2. The learned counsel for the 4th respondent Society submits with reference to the contents of the counter affidavit already filed before this Court that, the petitioner purchased the property from the said Society and the title, possession and such other rights, which the Society was having on the property, have been fully conveyed to the petitioner herein.

3. Heard the learned Government Pleader as well.

4. In the above circumstances, there will be a direction to the 5th respondent to take further steps pursuant to Ext.P11 and to effect the mutation in the revenue records in favour of the petitioner and shall also accept the land tax in terms of the Kerala Land Tax Act as and when the same is rendered. The proceedings as above shall be finalised at the earliest, at any rate, within 'two weeks' from the receipt of a copy of this judgment.

W.P(C) No.113 of 2015 Writ petition disposed of. The petitioner shall produce a copy of this judgment along with a copy of this writ petition before the concerned respondent for further steps.
