J U D G M E N T
The petitioners have approached this Court with the following prayers:
"i) to call for the records in the case ii) issue a writ in the nature of mandamus or any other writ, order or direction commanding respondent Nos.1,2 and 4 to allow the petitioner to remove red earth from their land at the earliest;
iii) issue a writ in the nature of prohibition or any other writ, order or direction commanding respondent Nos.1,2 and 4 not to obstruct the petitioners while they are proceeding with their works for the construction of their dream home.
iv) issue such other writ, order or direction that are deemed fit in the facts and circumstances of the case."
2. When the matter is taken up for consideration, the learned Counsel for the petitioners submits that the grievance of the petitioners has already been projected by filing an application before the first respondent/Geologist , which is still to be acted upon. The only prayer raised before this Court is for
W.P.(C)No.127 OF 2015 issuance of a direction to the first respondent to cause the same to be considered and disposed of within a reasonable time.
3. Heard the learned Government Pleader as well.
4. Considering the limited nature of relief pressed before this Court, it is not necessary to adjudicate the issue on merits. Accordingly, the writ petition is disposed of directing the first respondent/Geologist to consider the application preferred by the petitioners , at the earliest, at any rate, within three weeks from the date of receipt of a copy of the judgment, after affording an opportunity of hearing to the petitioners or their representative. The petitioners shall produce a copy of the judgment along with a copy of the writ petition before the first respondent/Geologist for further steps.
