J U D G M E N T

The petitioner has approached this Court with the following prayers:

"i) Issue a writ of mandamus or any other writ, order or direction directing the respondents to pay Rs.62,81,890/- which is the part bill amount due to the petitioner in respect of the work undertaken for the construction of improvement to colony approach road at Thrissur sub division forthwith and ii) Pass such other orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case."

The learned standing counsel appearing for the respondents (Railway) submits that there is no dispute with regard to the factual position and that the due amount payable to the petitioner has already been disbursed on the day before yesterday.
