J U D G M E N T

The petitioner had a regular permit in the route Thodupuzha - Ernakulam. The petitioner having obtained Clearance Certificate keeping the permit under suspended animation, obtained release of the vehicle, which was run in the route and sold the same. However, the petitioner admittedly did not replace the vehicle within a reasonable time. The permit also has expired in the year 2014. The petitioner has now filed an application for renewal produced at Ext.P3, application for condonation of delay produced at Ext.P3(a) and a replacement is also sought for by Ext.P4. The only prayer sought for is consideration of the same. Definitely, the Regional Transport Authority would have to consider the same expeditiously, but, however, considering the other work which is pending before the RTA.

2. In such circumstance, there shall be a direction to consider the application for renewal and the delay condonation as also application for replacement in accordance with law. It is made clear that this Court has not made any observation on merits with respect to the claim of the petitioner. The application for temporary permit also shall be considered by the Secretary RTA expeditiously.

The writ petition is disposed of.
