JUDGMENT
The petitioners have approached this Court seeking the following reliefs:
i.
Declare that the properties comprised in Sy Nos.696, 699, 701, 702, 703, 706, 707, 715, 716, 717, 721, 732, 733, 734, 735, 737, and 739 in Marathakara Village, Thrissur Taluk and covered by Ext.P1 and P1 (a) consent letters are not properties within the meaning of "paddy land" as defined under section 2 (xii) of Kerala Conservation of Paddy Land and Wet Land Act, 2008 and therefore the provisions of the said Act are not applicable to the aforesaid lands, ii.
Issue a writ of certiorari or any other appropriate writ or order quashing Ext.P12 order to that extent it imposes conditions to the effect that the petitioners shall carry out fish farming in the said properties, only during intermediary period between two paddy seasons and shall mandatorily carry out paddy cultivation in the said properties iii. Issue a writ of mandamus or any other appropriate writ order directing the respondents to grant permission to the petitioner to remove the soil from the properties covered by Ext.P1 and P1(a) and to conduct fish farming therein,
iv. Issue a writ of mandamus or any other appropriate writ or order directing the 5th respondent to take appropriate action upon Ext.P10 application submitted by the petitioners for removal of their properties from the data bank.
2. The learned counsel for the petitioners submits that the property concerned herein is actually not a paddy land or wet land as defined under section 2(xii) and 2(xviii) of Act 28 of 2008. It is also pointed out that the land is not fit for paddy cultivation and no cultivation was being effected in the said property for decades as evident from Ext.P8. The learned counsel submits that the petitioners have moved the fifth respondent by filing Ext.P10 for removing the property of the petitioners from the data bank register and that the petitioners will be satisfied if a direction is given to the the said respondent to cause the matter to be considered by the Local Level Monitoring Committee and do the needful within a reasonable time.
3. Heard the learned Government Pleader as well.
4. In the above circumstances, the fifth respondent is directed to forward Ext.P10 to the Convener of the Local Level Monitoring Committee forthwith at any rate within one week;
upon which the same shall be caused to be considered and appropriate orders shall be passed by the above Committee, in accordance with the relevant provisions of law, after conducting a site inspection with notice to the petitioners. The proceedings as above, shall be finalized, at the earliest and at any rate within two months from the date of receipt of a copy of this judgment.
5. The rights and liberties of the petitioners, to have Ext.P12 to be reconsidered, will depend upon the outcome of the order to be passed by the Local Level Monitoring Committee. The petitioners shall produce a copy of this judgment along with a copy of the writ petition before the concerned respondent for further steps.
