J U D G M E N T
The petitioner has approached this Court with the following prayers:
"i.
issue a writ of certiorari or any other appropriate order or direction quashing Ext.P12 order of the 4th respondent and Ext.P13 proceeding of the 3rd respondent;
ii.
issue a writ of mandamus or any other appropriate order or direction commanding the 3rd respondent to re-consider Ext.P9 application and to issue the necessary permission for the collection of brick earth for the purpose of M/s. Standard Tile & Clay Works (Private) Limited;
iii.
Issue any appropriate writ, order or direction declaring that no environmental clearance is required for the collection of brick earth from an area of less than 5 hectares, as insisted in Exts.P10, P11 and P11(a), and hence the condition insisted by the 4th respondent in Ext.P12 is erroneous and unsustainable in law;
iv.
Issue such other writ, order or direction which may deem fit in the facts and circumstances of the case."
2.
The learned counsel for the petitioner submits that, the grievance of the petitioner has already been projected by way of
WP(c). No.1140 of 2015 Ext.P14 before the 2nd respondent and that the petitioner will be satisfied, if a direction is given to the said respondent to have it considered and finalized within a reasonable time. 3.
Heard the learned Government Pleader as well. 4.
In view of the limited extent of relief sought for, this Court does not find it necessary to go through the merits of the case. The writ petition is disposed of, directing the 2nd respondent to consider and pas appropriate orders on Ext.P14, in accordance with law, after affording an opportunity of hearing to the petitioner. It shall be done, at the earliest, at any rate, within 'two months' from the date of receipt of a copy of this judgment. The petitioner shall produce a copy of this judgment along with a copy of the writ petition before the 2nd respondent for further steps.
