J U D G M E N T

The petitioner seeks assignment of 10 cents of land in Survey No. 912 of KDH Village, Devikulam Taluk. The petitioner was earlier before this Court with a writ petition in which the petitioner obtained a judgment at Ext.P1, in which it is stated that 10 cents of land in Sy. No.1268and 1269of Mannankandom Village can be assigned to the petitioner. The said land was not available. In such circumstance, the Deputy Tahsildar identified one another land in KDH village in survey NO.912 and sent a report to the Tahsildar. The Tahsildar has placed the matter before the District Collector.

The learned Government Pleader has produced the letter at Ext.R3(a) by which the Deputy Tahsildar, has forwarded it to the Tahsildar, Devikulam. The Tahsildar Devikulam shall forward the same to the District Collector. The District Collector

shall after affording an opportunity for hearing decide the matter in accordance with law, within a period of three months from the date of receipt of the communication from the Tahsildar in accordance with law and observing all the formalities. Writ petition is disposed of.
