J U D G M E N T
The challenge in the above writ petition was with respect to the anticipated promotion of the 3rd respondent. 2.
Admittedly, subsequent to the filing of the writ petition the 3rd respondent was promoted on 1.7.2006. The petitioner did not amend the writ petition, to challenge the said promotion itself.

Though the learned counsel for the petitioner submits that the grounds raised would be sufficient to assail the subsequent promotion, it was incumbent upon the petitioner to have raised a specific challenge against the promotion made; at least by an amendment.

Further, it is submitted by the learned counsel for the 3rd respondent that the 3rd respondent was further promoted as Senior Foreman with effect from 26.07.2010.
W.P.(C) No. 11963/2006 -2In such circumstance, nothing survives in the writ petition and the same is dismissed.
