JUDGMENT

The petitioner, who is an Indian citizen, intends to marry a girl, by name Julie Mathew, who is a U.S. National of Indian origin, in the first week of March, 2015 under the Special Marriage Act. The petitioner has given Ext.P3 notice of intended marriage before the 1st respondent, but the same has been rejected vide Ext.P4 order stating that as per letter No.8201/E/2012 D dated 16.07.2014 issued by the Government and letter No.RR 3. 25537/2000 dated 08.08.2014 issued by the 2nd respondent, solemnization of marriage with a foreign citizen under the provisions of the Special Marriage Act, 1954 is not allowed.

2. Heard the learned Government Pleader as well.

3. The point stands answered in favour of the petitioner, vide judgment of this Court in WP(C) No.22261 of 2014. Obviously, the difficulty experienced by the Marriage Officer is on

account of the non-appointment of Marriage Officer in Foreign countries so as to comply with the procedures under Section 5 & 6(3) of the Special Marriage Act. Notice under Section 5 is mandatory. Certainly, the purpose of such notice is to verify the credentials and identity of the Foreign National who intends to marry an Indian National. In the absence of appointment of marriage officer in a country to which the Foreign National belongs, notice as contemplated under Sections 5 and 6(3) cannot be issued. This Court in WP(C) No.22261 of 2014 has held that, the purpose can be achieved in a credible manner, if a certificate from the Consulate General of the Country of Origin is produced. In this case, the petitioner places reliance on Exts.P1,P2,P5 and P6 to satisfy the purpose of notice.

The writ petition is disposed of, directing the first respondent to accept Ext.

the Special Marriage Act.

The petitioner shall produce a copy of this judgment, along with a copy of the writ petition, before the first respondent, for further steps.
