JUDGMENT

Against Ext.P1 assessment order and Ext.P2 penalty order under the Kerala Value Added Tax Act, 2003, the petitioner preferred Ext.P3 appeal and stay petition before the 3rd respondent and Ext.P4 appeal and stay petition before the 2nd respondent. It is the case of the petitioner that even prior to consideration of the stay petition by the 2nd respondent, recovery steps have been initiated against him through Ext.P5 demand notice, for recovery of the amounts confirmed in the assessment order.

2. I have heard Sri.George Abraham, learned counsel appearing for the petitioner and Smt.Sobha Annamma Eappen, learned Government Pleader for the respondents.

3. On a consideration of the facts and circumstances of the case and the submissions made across the Bar, I dispose the writ petition with a direction to the 3rd respondent to consider and pass orders on Ext.P3 stay petition within a period of two months after hearing the petitioner. Similarly, the 2nd respondent, or the authority competent to entertain revision petition against Ext.P2 penalty order, shall consider and pass orders on Ext.P4 stay petition preferred by the petitioner within a period of two months

from the date of a copy of this judgment, after hearing the petitioner. Pending consideration of the stay petitions by the authorities referred to above, and communication of the orders passed by them to the petitioner herein, further proceedings pursuant to Ext.P5 demand notice shall be kept in abeyance.

4. To enable the stay petitions against Ext.P2 penalty order to be disposed in accordance with this judgement, the Deputy Commissioner of Commercial Taxes, Wayanad shall ensure that Ext.P4 appeal and stay petition are immediately placed before the authority competent to decide the revision applications against Ext.P2 penalty order.
