JUDGMENT
Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondent, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself.
2. Briefly stated, the petitioner, a private limited company, after obtaining the necessary building permit from the respondent Municipality raised some structures meant for establishing a hotel. Ever since the building has been constructed, the petitioner continued to pay the necessary property tax. Later, owing to certain difficulties, as he discontinued his business, the petitioner is said to have let out these structures for establishing a hospital.
3. The grievance of the petitioner is that though presently a hospital is established in the petitioner's premises,
WPC 3818/15 still the respondent Municipality has been insisting on payment of property tax as if the petitioner had been continuing with his hotel business. In that regard, the petitioner is said to have submitted Exhibit P4 application to the second respondent for revision of property tax, based on the change in the user of the property. Complaining of its non consideration, the petitioner has approached this Court.
In the facts and circumstances, having regard to the respective submissions of the learned counsel for the petitioner and the learned Standing Counsel, this Court, without adverting to the merits of the matter, disposes of the writ petition with a direction to the second respondent to consider Exhibit P4 application of the petitioner in accordance with law and pass appropriate orders thereon, as expeditiously as possible, at any rate, within a period of one month from the date of receipt of a copy of this judgment.
