J U D G M E N T

The petitioner has approached this Court with the following prayers:

"i) issue a writ of mandamus or any other appropriate writ order of direction, commanding 1st respondent to remove the petitioner's land comprising in Resurvey No.310/7-2 and 310/7-12 of Ennakkadu Village from the 'Data Bank' prepared as per Section 5(4)(i) of The Kerala Conservation of Paddy Land and Wetland Act in Budhanoor Panchayath.

ii) issue a writ of mandamus or any other appropriate writ order of direction, commanding 1st respondent to dispose off Ext P4 representation preferred by the petitioner forthwith."

The petitioner filed an application before the 1st respondent for removal of his land from the 'draft data bank', as per Ext.P4. It is stated that, the petitioner will be satisfied, if a direction is given to the 1st respondent to have it considered and finalised within a reasonable time.

Heard the learned Government Pleader as well. 4.

After hearing both the sides, the writ petition is disposed of, directing the 1st respondent to consider and pass

WP(c). No.4319 of 2015 appropriate orders on Ext.P4, in the light of a Division Bench decision of this Court in Adani Infrastructure & Developers Pvt. Ltd V. State of Kerala (2015 (1) KLT 651) and in Castlerock Projects and Developers Pvt Ltd & Another V. Revenue Divisional Officer, Fort Kochi, & others (2013 (3) KLT 545). It shall be done, as expeditiously as possible, at any rate, within 'two months' from the date of receipt of a copy of this judgment.

The petitioner shall produce a copy of this judgment along with a copy of this writ petition before the 1st respondent for further steps.
