JUDGMENT
The petitioner is a final year regular student of the B.Pharm course conducted by respondents 1 and 2 through the 3rd respondent College. The petitioner has cleared the 1st and 3rd years. However, in the 2nd year, he failed in one subject in the regular examination conducted on the close of the said academic year. The petitioner then appeared for the supplementary examination in December-2014 and failed to qualify in that also. Now the final year examinations are scheduled to commence from 23.3.2015. The petitioner seeks that he may be permitted to provisionally appear in the said examination, since he has applied for revaluation in the failed subject.
2. It is to be noticed that it is not the
WP(C).8718/15 regular examination in which the petitioner has failed and now seeks provisional admittance to the next examination for reason only of pending revaluation. The petitioner had once appeared for the regular examination and failed. He failed to qualify in the supplementary examination also. In such circumstances, this Court is of the opinion that no relaxation can be granted to the Regulations of the University which mandates that all the three years should be completed successfully before appearance in the 4th semester examination.
The writ petition is found to be devoid of merit and the same is dismissed in limine.
