JUDGMENT
The petitioner is an assessee under the Kerala Value Added Tax Act, 2003, hereinafter referred to as 'KVAT Act'. Against Exts.P1 and P2 orders of penalty passed under the KVAT Act, the petitioner preferred Exts.P3 and P4 appeals and Exts.P5 and P6 stay petitions before the 2nd respondent. The 2nd respondent posted the stay petition for hearing, on which date, the petitioner was not represented before the 2nd respondent. Accordingly, by Ext.P7 order, the stay petitions were dismissed by the 2nd respondent. It is aggrieved by Ext.P7 order, which dismissed the stay petition preferred by the petitioner, the petitioner preferred the writ petition.

I have heard the learned counsel appearing for the petitioner as also the learned Government Pleader appearing for the respondents.

On a consideration of the facts and circumstances of the case and the submissions made across the bar, and taking into account the fact that out of the total penalty amounts confirmed against the petitioner of Rs.2,91,337/-, the petitioner has already

No. 9229 of 2015 effected the payment of Rs.75,892/- during the pendency of the proceedings, I dispose the writ petition with a direction to the 2nd respondent to consider and pass orders on Exts.P3 and P4 appeals preferred by the petitioner within a period of two months from the date of receipt of a copy of this judgment, after hearing the petitioner. The proceedings for recovery of amounts confirmed against the petitioner by Exts.P1 and P2 orders, shall be kept in abeyance till such time as the 2nd respondent passes orders, as directed, and communicates the same to the petitioner.
