JUDGMENT

The petitioner has approached this Court with the following prayers :

"(i) Issue a writ in the nature of mandamus commanding respondent No. 2 to consider Ext. P3 application under Form 10 for measurement and demarcation of the boundaries of the pathway described in Ext. P2 complaint before the SDM, Palakkad with notice to the petitioner and and all affected parties within a time bound manner.

(ii) Issue such other order or direction as this Hon'ble Court may deem fit and proper in the circumstances of the case.

2. The learned counsel for the petitioner submits that the petitioner will be satisfied, if a direction is given to the second respondent to consider and pass appropriate orders on the application preferred by the petitioner along with Form 10 for measurement and fixation of the boundaries, vide Ext. P3, in respect of the property covered by Ext. P1 title deed within a reasonable time.

3. Heard the learned Government Pleader as well.

4. Considering the limited extent of relief sought for, this Court does not find it necessary to go into the merits of the case. The writ petition is disposed of, directing the second respondent to consider and pass appropriate orders on Ext. P3 application in accordance with law, after affording and opportunity of hearing to the petitioner and other interested parties, if any, at the earliest, at any rate, within two months from the date of receipt of a copy of this judgment.

The petitioner shall produce a copy of this judgment along with copy of the writ petition before the second respondent for further steps.
