The complaint of the petitioner is that Exhibit P1 complaint preferred by him was not attended to and it was not disposed of.
2. The learned Government Pleader submits that the same was considered as per the orders of this Court and the same was disposed of on 09.10.2009. Therefore, any further direction to dispose of the complaint is not required.
3. According to the petitioner, he was falsely implicated in and an Abkari case, presently pending as S.C.No.40 of 2010 before the Additional Sessions Court, Thrissur. Exhibit P4 Final Report in the case reveals that both the accused in the case had allegedly transported spirit in 4 cans, 2 having 35 litres capacity and 2 having 5 litres capacity, by Car bearing Registration No.KL-7-AQ-5657
W.P.(C).No.9620 of 2015 belongs to the 2nd accused, who is the petitioner herein, to the toddy shop of the petitioner at 9.40 p.m. on 16.07.2009. The said spirit was allegedly seized during such transit. It is hard to believe the case of the petitioner at present. There is no reason to interfere with the matter. This Writ Petition is devoid of merits, and is only to be dismissed, and I do so. In the result, this Writ Petition is dismissed. Sd/- B. KEMAL PASHA JUDGE DSV/8/10/15 // True Copy // P.A. To Judge
