The petitioner, who is working as a Assistant Central Intelligence Officer Grade-II under the 1st respondent, was deployed at the Cochin International Airport to work under the 1st respondent. While working consequent to the deputation order, the petitioner was served with Ext.R3(l) Office Order repatriating him to his parent institution and relieving him from his duties at the Cochin International Airport under the 1st respondent, with effect from 13.3.2015. In the writ petition, the petitioner has impugned the action of the 1st respondent in directing a repatriation to the parent department, even prior to the expiry of the period of deputation under Ext.P1 order.
When the matter was taken up today, a statement is filed on behalf of the 1st respondent, wherein, it is stated that the 1st respondent has decided to keep the repatriation order issued against the petitioner in abeyance till the expiration of the deputation period
W.P.(C).No.9977/2015 as per Ext.P1. In the light of this submission on behalf of the 1st respondent, the prayers in the writ petition have virtually been granted by the 1st respondent, and, therefore, nothing survives to be decided in this writ petition. Accordingly, recording the submission of the 1st respondent contained in the statement filed by the Central Government counsel, the writ petition is closed as infructuous.
