JUDGMENT

1. Petitioners are students, who have 50%, 49% and 53% of attendance in the 8th semester of the course, in which they are studying, under the respondent University. Petitioners contend that, their attendance shortage was only due to the suspension effected by Ext.P1, as also the participation Arts and Cultural activities. If the petitioners are desirous of pursuing in Arts and Cultural activities, rather than their studies, then, that is left to them. However, the required percentage of attendance definitely has to be complied with.

2. It is the admitted position that the required attendance percentage is 75% and the petitioners are far below the same. If the petitioners have been suspended, that cannot be reckoned for attendance, since it would totally efface the punishment and put on premium, students who were suspended, from getting attendance

without attending classes. Considering all the above aspects, this Court is not inclined to grant any orders, directing participation of the petitioners in the examination, which would stand against the Regulations of the University. Writ petition would stand dismissed.
