JUDGMENT

The petitioner is aggrieved with the issuance of the regular permit granted as per the proposed set of timings to nd respondent as shown in Exhibit P3 the service of the 2 nd respondent agenda, item No.1. The service operated by the 2 covers a major portion of the route in which the petitioner is operating his services.

2. The issuance of the permit is as proposed by the nd respondent, to which timings the petitioner has already filed objections as evidenced by Exhibit P4. It is averred by the petitioner that the grant of permit has been made in favour of nd respondent subject to settlement of timings. In such the 2 st respondent has to consider the circumstance, the 1 objections of the petitioner when timing conference is fixed for nd respondent.

3. In the above circumstance, if Exhibit P4 objection st respondent, then a timing is received in original by the 1 nd conference shall be convened in respect of the service of the 2 respondent, expeditiously, and the petitioner's objection shall be considered in the timing conference so scheduled. The writ petition is disposed of as above.
