JUDGMENT
The petitioner has approached this Court with the following prayers :
(i) Issue a writ in the nature of mandamus or any other appropriate writ commanding the 1st respondent to consider and pass orders on Exhibit P4 application filed by the petitioner under Rule 43 of the Kerala Survey and Boundary Rules without any further delay and (ii) To pass such other orders or reliefs as this Hon'ble Court deems fit in the interest of justice.
2. The learned counsel for the petitioner submits that the petitioner will be satisfied, if a direction is given to the first respondent to consider and finalize Ext. P4 application preferred by the petitioner in Form 10, for pointing out the boundaries of the property mentioned in Ext. P1, within a reasonable time.
3. Heard the learned Government Pleader as well.
4. Considering limited extent of relief sought for, this Court does not find it necessary to go into the merits of the case for the
W.P.(C) No. 11425 of 2015 : 2 :
time being. The writ petition is disposed of, directing the first respondent to finalize the proceedings pursuant to Ext. P4 in accordance with law, with notice to the petitioner and other interested parties, if any, at the earliest, at any rate, within three months from the date of receipt of a copy of this judgment. Petitioner shall produce a copy of this judgment along with copy of the writ petition before the first respondent for further steps.
The Writ Petition is disposed of.
