JUDGMENT
The petitioners have approached this Court with the following prayers:
"(i) To call for the records relating to Exhibit-P1 to P9 and to issue a Writ of Mandamus or any other appropriate writ, direction or order declaring that the petitioners Akshaya E-Centre Entrepreneurs are the most eligible governmental approved agency for doing the renewal of Ration Card work and such other similar works being the Commen Service Centres declared by the Government.
(ii) To issue a writ of Mandamus or any other appropriate writ, direction or order directing the respondents 2 to 7 to allot the entire second phase of DATA entry work in relation to ration card renewal to the Akshaya Centres, through their respective centres, forthwith.
(iii) To issue an interim order to the respondents 2 to 7 to allot the DATA Entry work of ration card renewal to the Petitioners and such other Akshay E Centres and to do the same through their respective centres forthwith, in the light of Exhibit P9 interim order, pending disposal of the Writ Petition (Civil).
(iv) To issue any other appropriate writ, direction or order to meet out justice in the facts and circumstances of this case."
2. The learned Standing Counsel appearing for the C-DIT submits that, a portion of the DATA entry work has already been given by the Government to the C-DIT and that the rate has been
W.P.(C) No.11460 of 2015 fixed as per G.O. No.(Ord)No.90/15FCSD dated 17.03.2015. If any grievance is there, it is for the petitioners to approach the Government/District Collector, who is the competent authority to consider the same.
3. The learned counsel for the petitioners submits that, the petitioners would like to pursue the matter before the 5th respondent/District Collector by filing a proper representation.
4. In the said circumstances, the petitioners are relegated to approach the 5th respondent by filing necessary application within 'two weeks' from the date of receipt of a copy of this judgment, upon which, the same shall be considered and appropriate orders shall be passed, after affording an opportunity of hearing to the petitioners and also the C-DIT, at the earliest, at any rate, within 'one month' therefrom.
The petitioner shall produce a copy of this judgment, along with a copy of the writ petition, before the 5th respondent, for further steps.
