J U D G M E N T

Grievance of the petitioner is mainly with regard to illegal filling up of paddy land, which is being done by the respondents 6 and 7 absolutely without any regard to rule of law . Inspite of the fact that the matter has already been brought to the notice of the concerned respondent and that the Village Officer has already issued a stop memo, the activity is still going on. This made the petitioner to approach this Court by filing this writ petition.

2. Heard the learned Government Pleader as well. It is seen that the petitioner has already moved the first respondent/District Collector, who is the competent authority under Act 28 of 2008 by filing Ext.P3. It is also seen that some endorsement has been made by the District Collector thereon, which presumably led to the proceedings by way of Ex.P6 issued by the third respondent /Village Officer .

3. The proceedings have to be taken to a logical conclusion. In view of the fact that the merit need not be considered by this

W.P.(C)No. 11853 OF 2015 Court at this stage, it is not necessary to issue any notice to the respondents 6 and 7 for the time being.

4. The writ petition is disposed of directing the first respondent/District Collector to consider and finalise the proceedings forming the subject matter of Ext.P3 after affording an opportunity of hearing to the petitioner and the respondents 6 and 7 at the earliest, at any rate, within one month. The petitioner shall produce a copy of the judgment along with a copy of the writ petition before the first respondent for further steps.
