JUDGMENT
Heard the learned counsel for the petitioners and the learned Standing Counsel for the respondent Corporation, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself.
2. Briefly stated, desirous of constructing a commercial building in the place of an existing residential building, the petitioners are said to have submitted Ext.P5 application for building permit. Ventilating their grievance that Ext.P5 application has so far not been considered by the respondent Corporation, the petitioners have filed the present writ petition.
3. The learned Standing Counsel for the respondent Corporation has submitted that the revenue records reflect the property as 'nilam'. According to him, unless there are appropriate orders from the authority either under the Kerala Land Utilisation Order or under the Kerala Conservation of Paddy Land and Wet Land
W.P.(C.) No. 11979/2015 -2Act, 2008, the respondent Corporation cannot proceed further.
4. Be that as it may, the fact remains that the petitioners have submitted Ext.P5 application for building permit; so far, it has not been decided. It meets the ends of justice, if the respondent Corporation considers the application in reference to the extant statutory position and passes appropriate orders thereon. In the facts and circumstances, having regard to the respective submissions of the learned Counsel for the petitioners and the learned Standing Counsel, this Court, without expressing any opinion on the merits of the matter, disposes of the writ petition with a direction to the 2nd respondent to consider the petitioners' Ext.P5 application in accordance with law and pass appropriate orders thereon, as expeditiously as possible, at any rate, within one month from the date of receipt of a copy of this judgment. sd/- DAMA SESHADRI NAIDU, JUDGE.
