JUDGMENT

The petitioner seeks correction of the date of birth in the passport. He submits that his actual date of birth is 1.6.1962, whereas the same is entered in the passport as 20.5.1956. Inorder to correct the mistake occurred in the passport, he approached the respondent. The respondent took an adamant stand that as there is a difference of more than 2 years, the mistake cannot be rectified, unless there is a direction by the Court.

2. I heard the learned counsel appearing on both sides. The petitioner has produced a copy of the S.S.L.C. book in which his date of birth is entered as 1.6.1962. He also relies on the judgment of this Court in Swapna Siju v. Passport Officer (2012 (4) KLT 419), according to which the date of birth can be corrected in case of a person borne before 26.1.1989 relying on S.S.L.C book.

3. In the light of the judgment of this Court and in the light

Accordingly the writ petition is disposed of as follows: The petitioner shall submit an application before the respondent seeking correction of date of birth within a period of two weeks. The respondent shall accept the same, process and dispose of the same in accordance with law within a further period of four weeks.
