JUDGMENT

The petitioner has approached this Court being aggrieved of the alleged unauthorised filling up of paddy land belonging to the th respondent, without any regard to Exts.P2 and P3. It is also st respondent by pointed out that the petitioner has moved the 1 filing Ext.P5 complaint which stands left in cold storage and hence the writ petition.

2. Heard the learned counsel appearing for the party respondents as well, who submits that, they have not effected any unauthorised filling and there is absolutely no basis for the complaint.

3. The learned counsel for the respondent Panchayath submits with reference to the statement dated 29.1.2015 filed before this Court that, out of the total extent of 43 cents, permission was given to have an extent of 10 cents converted, so as to construct a residential building therein. The said extent was filled up and residential building was put up and the concerned

W.P.C. No. 17217 of 2012 -2respondent is residing in the said building. The balance 33 cents still remains as 'paddy land' and that no filling exercise is possible in the said property. A copy of the application preferred by the th respondent before the concerned authority and a copy of the order dated 02.04.2012 passed by the Agricultural Officer in this regard are produced as Exts. R2(a) and R2(b) respectively. Ext.R2(c) is the consent given by the Panchayath to effect construction of the building. The building has already been assigned number and tax has been remitted pursuant to Ext. R2 (d) judgment passed by this Court in W.P.(C). No. 8501/2014. After hearing both the sides, this Court does not find any reason to retain the writ petition and the same stands closed making it clear that, balance property shall be retained as 'paddy land' as it is.
