JUDGMENT

Aggrieved by the inaction on the part of the respondents 3 and 4 in taking appropriate action on Ext.P3 complaint and Ext.P7 letter respectively submitted by the petitioner against the alleged illegalities committed by the 6th respondent using the vehicle purchased in the name of the petitioner while he was in service of the respondent company, the petitioner has come up before this Court.

2. The petitioner alleges that he is a permanent resident of Vaikom at Kottayam and was working as Manager (Sales and Marketing) under the 5th respondent company. He further alleges that he had resigned from the 5th respondent through his letter dated 8.12.2014 and his resignation was accepted vide letter dated 7.1.2015 issued by the 6th respondent in his capacity as the Managing Director of the company.

3. The petitioner further alleges that due to the negligence and dereliction of duty on the part of respondents 3 and 4, he is put to irreparable loss and injuries. The 6th respondent, his men and agents are intentionally and deliberately indulging in committing offenses using the aforesaid vehicle, which is in possession and custody of the 5th respondent. The petitioner points out that he is already in receipt of Ext.P4 series and Ext.P5 charge memo for over speeding using the aforesaid vehicle and the date of violation is subsequent to the 6th respondent taking possession of the vehicle.

The petitioner apprehends that the vehicle in question would be utilised for committing grave offenses and in such circumstance, he would be unnecessarily dragged into heinous crimes affecting the future life and career. The 6th respondent is acting with mala fide intention by harassing the petitioner since he was resigned from service of the respondent company. Though he preferred Exts.P3 and P7, no action has been taken on the same by the authorities

5. Arguments have been heard.

6. As the only grievance of the petitioner is that his complaints were not considered by the respondents, the writ petition is disposed of with a direction to respondents 3 and 4 to consider Exts.P3 and P7 after affording the petitioner an opportunity of being heard, within a period of one month from the date of receipt of a copy of this judgment. To facilitate early action, it shall be open to the petitioner to produce a copy of this judgment along with Exts.P3 and P7 before the respondents concerned.
